The Case of Roe v. Wade (1973)

Abortion Legal Precedent – Background:

  • Case: Roe v. Wade, 410 U.S. 113 (1973)
  • Issue: The constitutionality of laws that criminalize or restrict access to abortions.

Precedent Established:

  • Ruling: The U.S. Supreme Court ruled that the right to privacy under the Due Process Clause of the 14th Amendment extends to a woman’s decision to have an abortion. This established a precedent that abortion laws must not place an undue burden on a woman’s right to choose.
